Man who raped minor three times and filmed her claims he was the victim

A man in his 30s who sexually assaulted a minor three times and produced sexual exploitation material of her claimed he was the one who had been wronged — but the court was not persuaded.

The First Criminal Division of the Seoul High Court's Chuncheon branch dismissed the appeal of A, 31, who was charged with violating the Act on the Protection of Children and Youth Against Sex Offenses, upholding the lower court's sentence of four years in prison, according to legal sources Saturday. The court also confirmed the first-instance orders barring him from working at child- and youth-related institutions for seven years and placing him on probation for three years.

A is accused of having sexual intercourse with B, a minor under the age of 16, on five separate occasions. In one instance, he secretly filmed the act, producing sexual exploitation material.

The first-instance court sentenced him to four years in prison, finding his conduct immoral and the nature of the crime poor. A acknowledged all charges before the appeals court.

In a written statement of remorse submitted to the court, however, he argued he had been treated unjustly. "Why should I be punished just because I am a man, when I was the one who was wronged?" he wrote.

Presiding Judge Lee Eun-hye rebuked him for his contradictory stance. She asked A, "Do you admit wrongdoing in the courtroom, but then feel aggrieved once you are back in the detention center?" She pressed him further, saying, "You seem to feel deeply wronged — please tell me your honest feelings."

The court said it took into account the absence of physical violence or threats as mitigating factors.
