Delivery driver walks into stranger's home at 11 p.m., asks: 'Did you order chicken?'

A delivery driver who entered a stranger's home late at night has been fined for trespassing.

According to JTBC's "Sageon Banjang," a crime news program, a viewer identified only as A was asleep at home around 11 p.m. on July 23 when a noise prompted her to check her home security camera. The footage showed a helmeted man.

A rushed to the living room and came face to face with the delivery driver standing near the front door. When she asked why he had entered, the driver said the door had been open and asked whether she had ordered chicken from a particular restaurant.

The driver said he had assumed the person who placed the order had fallen asleep drunk, and that he had walked in because the door was open.

A had not ordered chicken that day. She also disputed the driver's account, saying only the door lock was broken — the door itself had been closed — and that the driver had entered without ringing the doorbell.

"The delivery slip listed only the unit number without specifying the building, so I think the driver went to the wrong building by mistake," A said. "But if there were no signs of anyone being home, he should have called the customer first."

Police who responded to A's call issued the driver a fine of 20,000 won ($14) on the spot for unauthorized entry under the Minor Offenses Act. A is preparing a civil lawsuit against the driver.

Attorney Park Ji-hoon, who appeared on the program, said trespass is an intentional crime. "It requires deliberate intent to enter — if someone walked in after confusing the building or unit number, the charge of residential trespass cannot apply," he said. He added that unauthorized entry can still be punished under the Minor Offenses Act.
