A teacher in his 30s who performed sexual acts on a middle school student has been sentenced to five years in prison on appeal — the same term handed down at trial.
The Daegu High Court's Criminal Division 2, presided over by Chief Judge Won Ho-shin, upheld the original five-year sentence in the appeal of the teacher, identified only as A, who was indicted on charges including quasi-rape of a minor. The court also ordered him to complete a 40-hour sexual violence treatment program and barred him from working at institutions serving children, youth and people with disabilities for 10 years.
A, a teacher at a middle school in North Gyeongsang Province, was brought to trial on charges of raping a student and producing sexual exploitation material at a gymnasium and his home between September 2021 and December 2022.
"The victim's side has firmly refused the criminal deposit and is petitioning for severe punishment," the court said. "Given the relationship between the defendant and the victim, the nature of the crime is grave and the degree of culpability is very high."
The court vacated the original ruling after finding errors in the application of law but imposed the same five-year sentence.
