Hotel owner who entered room despite guest's refusal receives suspended fine

A lodging owner who entered a guest's room without permission — claiming he needed to check for smoking — has received a suspended fine.

Judge Yoo Hyeong-ung of the Gwangju District Court's Criminal Division 10 sentenced A, a man in his 40s, to a fine of 1 million won (approximately $655) suspended for one year on charges of unlawful entry into a room.

A, the owner of a hotel in Dong-gu, Gwangju, is accused of entering an occupied guest room at around 11 a.m. on May 4 last year.

The guest inside told A that young women were sleeping undressed in the room and asked him to leave, but he refused. A had entered on the grounds that he detected a smell of cigarette smoke coming from the room.

The court acknowledged that "there appeared to be circumstances that gave reason to suspect smoking inside the room," but ruled that "the defendant's actions did not meet the legal requirements for a justifiable act under the criminal code."
