Man in his 50s gets suspended sentence for dragging drunk woman to motel outside nightclub

A man in his 50s who dragged an intoxicated woman in her 40s to a motel near a nightclub and sexually assaulted her has received a suspended prison sentence.

The 11th Criminal Division of the Uijeongbu District Court sentenced the man, identified only as A, to two years in prison, suspended for three years, on charges of abduction for indecent purposes and quasi-forced indecent conduct. The court also ordered him to undergo probation, complete 40 hours of sexual violence treatment classes, and barred him from working at institutions related to children, adolescents and people with disabilities for seven years each.

In the early hours of February 2024, A spotted a woman in her 40s, identified as B, staggering outside a nightclub in Guri, unable to keep her balance. He then dragged her to a nearby motel and sexually assaulted her.

Indicted after B filed a police report, A denied the charges in court. He said he had no intent to commit an indecent act, that he had not used force while moving to the motel and therefore had not abducted her, and that B had not been in a state of mental incapacitation or unable to resist — and that no assault had taken place.

Closed-circuit television footage from around the scene, however, showed A circling B for about 10 minutes as she struggled to stand on the street before approaching her. B's behavior captured in the footage also contained evidence consistent with a state of mental incapacitation.

"The victim appears to have suffered considerable shame as a result of this incident, and her harm has not been remedied," the court said in its ruling. "However, taking into account favorable circumstances — including that the defendant has no prior criminal record and did not proceed to a more serious crime through the abduction — the court sentences him to a suspended term."
