'Busan spinning-kick' attacker asks court to protect his prison allowance while victim awaits $64,800 payout

The man convicted in the "Busan spinning-kick" case — in which he assaulted a woman he had never met — has asked a court to guarantee him monthly access to his prison allowance. He has yet to pay the victim a court-ordered 100 million won ($64,800) in damages, drawing widespread public outrage.

The perpetrator, identified only by his surname Lee, filed a motion with the court to exempt 100,000 to 150,000 won of his monthly prison allowance from seizure, according to Yonhap News Agency on Monday.

The Busan District Court ruled in favor of the victim, surnamed Kim, in October 2024 in a 100 million won damages suit she filed against Lee.

Kim had planned to recover the damages by seizing Lee's prison allowance while he remains incarcerated. That effort has been stymied, however, because the balance in his allowance account has fallen below 1,000 won — in effect leaving nothing to seize.

If the court grants Lee's motion to adjust the scope of the seizure exemption, recovery would become even harder. A portion of the allowance that Kim could otherwise seize would be set aside for Lee's personal use.

"The perpetrator has never once voluntarily paid any compensation, and the balance in his allowance account has sat at just 850 won for months — so when am I ever supposed to receive 100 million won?" Kim said. "The victim cannot even collect the damages she is rightfully owed, and yet the court would guarantee the perpetrator access to his allowance for his own convenience — that makes no sense at all."
