Claim jumps from 50 billion to 500 billion won, reflecting 11 years of infringing product sales
Toxin-based drug maker Medy-Tox has increased its damages claim against Daewoong Pharma tenfold, from 50 billion won ($36.5 million) to 500 billion won.
The company said Thursday it had filed an amended claim with the court. The appeal of its trade secret infringement and damages lawsuit against Daewoong Pharma and others is before the Seoul High Court.
The revised claim reflects sales volumes and revenue from Daewoong Pharma's infringing products between 2014 and July 31, 2025, confirmed during the appeals process. Medy-Tox said it also took into account damages evidence gathered to date, the deliberate nature of the trade secret violations, and enhanced damages provisions under the Unfair Competition Prevention Act.
"Of this amount, we have filed a claim for 500 billion won as an 'explicit partial claim' — meaning we are seeking only a portion of the total compensable damages calculated so far," the company said. "Damages arising after Aug. 1, 2025, are not included in this calculation. We will continue to pursue legal action to protect our intellectual property and trade secrets."
